Referral Programme and Promotional Campaigns Rules

§1. General Provisions
- These Rules govern participation in the Referral Programme and Promotional Campaigns organised by ENGIT sp. z o.o. (ul. Stefana Jaracza 39, 33-100 Tarnów, Poland, KRS 0001109234) — the "Organiser".
- The Referral Programme and Promotional Campaigns constitute a public promise within the meaning of Art. 919 of the Civil Code. They are not a lottery or competition under gambling legislation.
- These Rules supplement the Terms of Service available at https://www.proompi.com/legal/terms. Matters not covered herein are governed by the Terms of Service.
§2. Referral Programme
2.1. Participation Rules
- Every registered Proompi user receives a unique referral code (referralCode) visible in their Account panel.
- The user (the "Referrer") may share the referral code with persons who do not yet have a Proompi Account (the "Referred User").
- The Referred User, when registering using the referral code, receives a sign-up bonus.
2.2. Rewards

Reward values may be changed by the Organiser; current values are published in the Account panel. The Organiser will give 14 days' notice of changes; changes do not affect rewards already granted.
2.3. Limits and Conditions
- Maximum number of referrals: no limit (subject to anti-abuse provisions).
- Code use: a referral code may only be used once per newly created Account.
- Award timing: the Referrer receives Bonus Credits within 7 days of the Referred User's first paid purchase.
- Prohibited: creating multiple Accounts to self-use referral codes; using codes from fictitious email addresses / identities; distributing codes via spam; purchasing Subscriptions solely to obtain referral rewards with the intent to immediately cancel (refund abuse).
- If the Referred User exercises their right of withdrawal within 14 days, the Referrer's reward is not granted or, if already granted, is reversed.
2.4. Referral Credits
- Bonus Credits granted under the Referral Programme are Bonus Credits within the meaning of the Terms of Service (§7.4).
- Credits are non-refundable, cannot be exchanged for cash, and cannot be transferred to a third party.
§3. Promotional Codes and Campaigns
3.1. Types of Promotional Codes

3.2. Rules of Use
- Each code has defined parameters at creation: discount value / number of Credits, expiry date, maximum uses (per user / globally), restrictions (e.g. new users only, specific Plans only), stacking rules (promotional offers generally cannot be combined unless stated otherwise).
- A code is redeemed at checkout by entering it in the "Promotional code" field.
- Abuse (including bulk use of single-use codes, code generation, system exploits) results in code invalidation and may result in Account suspension.
3.3. Seasonal Promotions and Marketing Campaigns
- The Organiser may launch temporary Promotional Campaigns (e.g. holiday promotions, Black Friday, partner campaigns).
- Each Promotional Campaign has a separate description published at https://www.proompi.com/promotions or in user communications, including: name and duration, participation rules, discount/bonus value, eligibility conditions.
- In the event of a conflict between these Rules and the rules of a specific Promotional Campaign, the Campaign rules prevail in respect of that Campaign.
§4. Personal Data
- The controller of personal data of Referrers and Referred Users is ENGIT sp. z o.o. (details in §1).
- Purposes and legal bases of processing: performance of the Referral Programme / Promotional Campaign — Art. 6(1)(b) GDPR (contract) or Art. 6(1)(f) GDPR (legitimate interest — fraud prevention); reward settlement — Art. 6(1)(b) GDPR; tax compliance — Art. 6(1)(c) GDPR.

§5. Taxes
- Consumers. Rewards under the Referral Programme (Bonus Credits) are granted as a bonus to a digital service and do not constitute a separate taxable benefit for the Referrer where their value falls within applicable tax exemption thresholds.
- For rewards of significant value (above the tax-free amount under Art. 21(1)(68a) of the Personal Income Tax Act), the Organiser is required to withhold flat-rate income tax (10%) and inform the Referrer.
- Businesses. The value of a reward may constitute business income subject to taxation by the Business under applicable law.
§6. Complaints
- Complaints regarding the Referral Programme or Promotional Campaigns may be submitted: by email to hi@proompi.com, or in writing to the Organiser's registered address.
- A complaint should include: contact details, description of the problem, and the expected resolution.
- Processing time: 14 days from receipt.
§7. Final Provisions
- The Organiser reserves the right to: amend these Rules — with 14 days' advance notice; terminate the Referral Programme or a Promotional Campaign early for valid reasons — while preserving participants' vested rights (granted rewards remain); introduce new Promotional Campaigns with separate rules.
- Jurisdiction: disputes with Consumers are resolved by the competent court under the Code of Civil Procedure. Disputes with Businesses are resolved by the court having jurisdiction over the Organiser's registered seat.
