Acceptable Use Policy (AUP)

This page is a translation for informational purposes. In case of discrepancy, the Polish version prevails.

This document ("Acceptable Use Policy" or "AUP") sets out the rules you must follow when using the Proompi Service operated by ENGIT sp. z o.o. (ul. Stefana Jaracza 39, 33-100 Tarnów, Poland, KRS 0001109234). The AUP is an integral part of the Terms of Service available at https://www.proompi.com/legal/terms. By accepting the Terms, you also accept the AUP.

1. Use Proompi Lawfully

Violation of the AUP may result in: a warning, feature restriction, account suspension, immediate termination of the agreement, and — in the case of legal violations — referral to law enforcement.

You agree not to use the Service in a manner that:

  • violates Polish law, EU law, or the laws of the country where you are located,
  • infringes copyright, neighbouring rights, trade marks, or other intellectual property rights of third parties,
  • violates personal rights, the right to image, or the privacy of third parties,
  • is contrary to good morals.

2. Prohibited Content

2.1. Illegal Content

You are prohibited from generating, uploading, or publishing content through the Service that:

  • promotes violence, terrorism, extremism, hate speech, or discrimination based on race, ethnicity, religion, sexual orientation, disability, or other protected characteristics,
  • contains criminal threats or incites the commission of offences,
  • promotes suicide, self-harm, or eating disorders,
  • is defamatory, abusive, or violates the honour of third parties,
  • constitutes Nazi, fascist, communist, or other criminal ideology propaganda (Art. 256 of the Penal Code).

2.2. Sexual Content

You are prohibited from:

  • generating, uploading, or publishing sexual content involving minors or content that may be considered as such (CSAM) — absolute prohibition,
  • generating pornographic (NSFW) content,
  • generating sexual content featuring recognisable individuals without their consent,
  • generating content suggesting non-consensual sexual activity (revenge porn, intimate deepfake).

2.3. Deepfakes and Impersonation

You are prohibited from:

  • creating deepfakes of real persons (public figures or private individuals) without their explicit consent,
  • generating content depicting public figures in a way that could mislead about their actual statements, actions, or views,
  • creating content impersonating a specific person, organisation, brand, or public institution,
  • using the voice, likeness, or speaking style of specific individuals in a way that could mislead recipients.

Exception: clearly satirical or parodic content within the bounds of law is permitted, provided it is unambiguously labelled as satire/parody.

2.4. Disinformation and Manipulation

You are prohibited from:

  • generating content that misleads on matters of public importance (health, elections, international affairs) with intent to spread disinformation,
  • creating content impersonating news articles, official statements, or medical/scientific sources,
  • generating false evidence, documents, invoices, or certificates,
  • manipulating photos or recordings to mislead about events that occurred.

2.5. Violence and Danger

You are prohibited from:

  • generating instructions relating to firearms, explosives, or biological/chemical weapons,
  • generating instructions for manufacturing dangerous substances,
  • generating content that could assist in committing crimes, suicide, self-harm, or life/health-threatening events,
  • generating content promoting dangerous challenges.

2.6. Cybersecurity

You are prohibited from:

  • generating malicious software (malware, ransomware, viruses, exploits),
  • generating content used for phishing or impersonating other websites,
  • generating code designed to circumvent security measures of systems or services,
  • attempting reverse engineering, scraping, or unauthorised automation of the Service.

2.7. Child Protection

Absolute prohibition on generating:

  • sexual content involving minors (CSAM),
  • content depicting children in dangerous, humiliating, or exploitative situations,
  • content using the likeness of a specific child without the consent of their legal guardian.

If such content is detected: the Account will be immediately blocked and the matter referred to the relevant law enforcement authorities (pursuant to Art. 304 § 2 of the Code of Criminal Procedure).

2.8. Copyright Infringement

You are prohibited from:

  • generating content that clearly imitates the style of a specific living artist without their consent, where the intent is to mislead about authorship,
  • uploading copyright-protected materials (photos, illustrations, texts) without authorisation to use them,
  • generating content using protected characters, brands, logos, or trade marks (Disney, Marvel, Pixar, Pokémon, etc.) commercially without a licence.

2.9. Medical, Legal, and Financial Information Safety

  • AI-generated content does not constitute medical, legal, or financial advice.
  • You are prohibited from presenting AI Content as professional expert advice in these fields (e.g. "doctor's diagnosis", "lawyer's opinion").

3. Rules on Prompts

Do not include in Prompts:

  • personal data of other persons without their consent (national ID numbers, identity documents, card data),
  • trade secrets, confidential data, or classified materials.

Note that Prompts may be processed by AI sub-processors (including in the USA). Do not enter data that should not leave the EU. Your Prompts may be stored by AI providers for up to 30 days for safety purposes (in accordance with their policies).

4. Fair Use of Resources

4.1. Prohibition of Technical Abuse

  • automating use of the Service (scripts, bots),
  • attempting to circumvent Credit limits or rate-limiting,
  • excessive or atypical AI resource consumption resembling a DDoS attack or budget exhaustion.

4.2. No Multi-Accounts

Creating multiple Accounts by the same person to circumvent FREE plan limits or promotional codes is prohibited.

4.3. No Reselling

Reselling access to the Service, Credits, or AI Content as a standalone service is prohibited (except for commercial use of AI Content under the licence described in §10 of the Terms).

5. Publishing on Social Media

When using publishing features (Instagram, Facebook, TikTok, LinkedIn, Threads):

5.2. AI Content Labelling (AI Act Art. 50)

  • TikTok and Instagram — automatic flagging (isAiGenerated: true),
  • Facebook, LinkedIn, Threads — your responsibility,
  • Deepfake — mandatory labelling where publication is legally permissible.

5.3. Do not publish AI-generated content in a manner that:

  • could mislead about authorship,
  • suggests it is an authentic recording/photo of a real event,
  • lacks required labelling where mandated by law.

6. Reporting Violations

6.1. Reporting Abuse

If you notice AI Content or User behaviour that violates the AUP, report it to:

  • form: https://www.proompi.com/report-abuse (if available)

6.2. Reporting Copyright Infringement (DMCA-like procedure)

Rights holders may report infringement to legal@proompi.com (alias: hi@proompi.com), providing:

  • identifying information of the complainant,
  • description of the infringed work,
  • location of the infringement in the Service (URL),
  • a statement under penalty of perjury that the complainant is authorised to bring the claim,
  • a signature (scan or email from a verified address).

Upon receipt of a valid notice we will promptly: (1) remove or block access to the infringing content (notice and takedown), (2) notify the affected User, (3) allow the User to submit a counter-notice.

7. Enforcement

7.1. Available Measures

In the event of an AUP violation we may:

  • issue a warning,
  • remove violating content,
  • restrict Account functionality,
  • suspend the Account (pending investigation) — typically 7 days,
  • terminate the agreement with immediate effect — for serious or repeated violations,
  • retain data required for legal claims,
  • report violations to law enforcement (e.g. CSAM, terrorism, fraud).

7.2. Procedure

Except for serious violations (CSAM, terrorism, violations posing a particular threat to life/health), before suspending or closing an Account we will ask the User to cease the violation, providing a reasonable deadline.

7.3. Appeals

If you believe a suspension/closure decision is unjustified, you may appeal to: appeals@proompi.com (alias: hi@proompi.com), within 30 days of the decision. We will process your appeal within 14 days.

8. AUP Changes

We may update the AUP when the law changes, new types of abuse emerge, or Service features are extended. We will notify you of significant changes with 14 days' advance notice.
